Marbella Inc. | Terms of Service

This Terms of Service Agreement ("Agreement") is a legally binding contract between Marbella Inc. ("Provider") and the individual or entity accessing or using the Marbella Music & Arts Festival services ("Customer"). By purchasing tickets, accessing, or using our services, you agree to be bound by the terms outlined below.

The Marbella Music & Arts Festival, USA
Order Date
The date Customer first accepts this Agreement (Effective Date).
Subscription Period
Single ticket purchase for the event period.
Event Fees
Fees are determined based on ticket type and are non-refundable except as expressly stated in this Agreement.
Payment Process
Automatic Payment: By purchasing tickets, Customer authorizes Provider to charge the payment method provided for the full amount of the ticket(s). Payment is processed immediately upon order confirmation.
Use Limitations
Tickets are non-transferable and may only be used by the individual named on the ticket. Access is limited to the event venue on the specified dates.
Framework Terms
This Agreement incorporates the following Framework Terms:
Key Terms: Defined below.
Common Paper Cloud Service Agreement Standard Terms Version 2.0, which are incorporated by reference. Any conflicts between this Agreement and the Standard Terms will be governed by this Agreement.
Key Terms
Customer: The individual or entity purchasing tickets or accessing services. If acting on behalf of a company, "Customer" refers to that company.
Provider: Marbella Inc., USA.
Effective Date: The date Customer accepts this Agreement by purchasing tickets or accessing services.
Governing Law: The laws of the State of California, USA.
Chosen Courts: The state or federal courts located in California, USA.
Technical Support
Provider will use commercially reasonable efforts to ensure uninterrupted access to event services during festival hours. In case of technical issues preventing access, Provider’s liability is limited to a prorated refund of fees for affected services, as applicable.
Covered Claims
Provider Covered Claims: Provider will indemnify Customer against claims that the event services infringe intellectual property rights when used as permitted under this Agreement.
Customer Covered Claims: Customer will indemnify Provider against claims arising from misuse of tickets, breach of this Agreement, or violations of applicable laws during event participation.
General Cap Amount
Provider's liability for claims is capped at the total fees paid by Customer in the 12 months preceding the claim.

For Customer: The email address provided during ticket purchase.
Additional Provisions
Ticket Resale and Transfers: Tickets may not be resold or transferred without prior written consent from Provider.
Event Modifications or Cancellations: Provider reserves the right to modify event details or cancel the event due to unforeseen circumstances (e.g., weather, safety concerns). In such cases, refunds or rescheduling options will be provided at Provider’s discretion.
Code of Conduct: Customers must adhere to all festival rules and regulations, including safety protocols and venue policies.
By accessing Marbella Music & Arts Festival services, you acknowledge that you have read and understood this Agreement and agree to its terms in full.
